These terms and conditions apply to the 4TH Down Racing app (hereby referred to as "Application") for mobile devices that was created by MeGG (hereby referred to as "Service Provider") as an Ad Supported service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.
Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, as such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

The Application uses Supabase for database management and user authentication. By using the Application, you acknowledge that your account data is stored and processed by Supabase in accordance with their Terms of Service and Privacy Policy.
Some functions of the Application require an active internet connection. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the application outside of a Wi-Fi area, your mobile network provider's agreement terms still apply. You may incur charges from your mobile provider for data usage, including roaming data charges. By using the application, you accept responsibility for any such charges. If you are not the bill payer for the device, it is assumed you have obtained permission from the bill payer.
The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application. It is your responsibility to ensure your device remains charged; if your device runs out of battery, the Service Provider cannot be held responsible.
The Application incorporates Artificial Intelligence (AI) technologies to provide certain features or services. By using the Application, you acknowledge and agree that AI may be used to process data and deliver functionalities. The Service Provider ensures that all AI usage complies with applicable laws and is designed to benefit the user experience.
The Service Provider may wish to update the application at some point. You agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.
The Application includes assets licensed from the following third-party platforms:
All third-party assets are used in accordance with their respective license agreements. These assets are licensed exclusively for use within this Application as incorporated end-use content. Users are strictly prohibited from extracting, copying, modifying, reproducing, redistributing, sublicensing, or otherwise using any of these assets outside of the Application, whether for commercial, private, personal, or any other purpose. This restriction applies to all 3D vehicle models, animated graphics (including Lottie animations), icons, and any other visual or interactive assets embedded in the Application. Violation of these restrictions constitutes infringement of the applicable third-party license agreements and intellectual property rights, and may result in legal action by the Service Provider and/or the original licensors.
4TH Down Racing offers two premium purchase options to access additional content:
Installment Plan charges are automatic at the start of each enabled round. You may cancel the plan at any time from your Google Play or App Store account; no future charges will be made, and any vehicles already unlocked remain associated with your account.
Refund Policy: Refunds are handled exclusively in accordance with the official policy of the store where the purchase was made (Google Play or Apple App Store). To request a refund, contact the respective store directly following their official procedures.
Access to prediction pools is subject to the following limits based on the user's plan:
These limits may be modified in future versions of the Application. Changes will be communicated through an update to these Terms.
4TH Down Racing includes social features such as pool chat rooms where users may communicate with each other. The chat is intended exclusively for communication related to the pools and the Application.
Zero-Tolerance Policy: The Service Provider maintains a zero-tolerance policy toward objectionable content. The following are strictly prohibited:
Reporting & Blocking: Users may report any message they consider objectionable by tapping the report button (🚩) available on each message in the chat. Users may also block other users from their profile view. All reports are reviewed by the Service Provider within 24 hours, and appropriate action will be taken, up to and including permanent removal of the reported content and suspension or termination of the offending account.
Enforcement: Accounts found to be posting objectionable content are subject to temporary suspension, permanent ban, or deletion at the sole discretion of the Service Provider. The Service Provider reserves the right to remove any content that violates these guidelines without prior notice.
The Application is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. The Application requires users to confirm they are at least 13 years old before creating an account. If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us at 4downrace@gmail.com and we will promptly delete that information.
The Application uses Google AdMob to display advertising. Google AdMob and its partners may collect advertising identifiers (such as Android Advertising ID or Apple IDFA), IP addresses, and other information as described in Google's Privacy Policy. This advertising is served to users aged 13 and older. For more information, see Google's Privacy Policy.
The Service Provider may periodically update their Terms and Conditions. You are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
